Covenants Appeals Board Preamble

The Board of Directors of the Fearrington Homeowners Association (FHA) believes that fairness and due process require that a procedure be established so that any member who is aggrieved by a decision of the Covenants Concerns Committee has the right of Appeal from that decision by an impartial body. IT IS HEREBY RESOLVED that a Covenants Appeals Board is created effective July 18, 2012 to review any complaint of a member who is aggrieved by a determination of the Covenants Concerns Committee.

A member is aggrieved if he or she filed a request for property modification which was denied; or is an adjoining property owner or a property owner across the street from the requesting property owner who believes that a request approved by the Covenants Concerns Committee should have been denied.

An Appeal shall be in writing and shall not exceed three (3) pages, double spaced, not counting exhibits, and must be filed with the Covenants Appeals Board within 14 days following the decision of the Covenants Concerns Committee.

The Covenants Appeals Board shall consist of: the President of the FHA, a representative from Fitch Creations, Inc. and a Covenants Committee person from an area/section of Fearrington not involved in the original property modification request.

The Covenants Appeals Board shall set the time and place of the hearing and at its sole discretion may invite the aggrieved member, members of the Covenants Concerns Committee and any other FHA member with an interest in the matter to the hearing to present their arguments.

The Covenants Appeals Board may, by a majority vote, affirm, reverse or modify the prior determination and its decision shall be final.
